The Islamic Republic of Iran, with a population of approximately 70 million, is a constitutional, theocratic republic in which Shia Muslim clergy dominate the key power structures. Government legitimacy is based on the twin pillars of popular sovereignty-–albeit restricted--and the rule of the Supreme Leader of the Islamic Revolution. The current supreme leader, Ayatollah Ali Khamenei, was not directly elected but chosen by a directly elected body of religious leaders, the Assembly of Experts, in 1989. Khamenei's writ dominated the legislative, executive, and judicial branches of government. He directly controlled the armed forces and indirectly controlled the internal security forces, the judiciary, and other key institutions. The legislative branch is the popularly elected 290-seat Islamic Consultative Assembly, or Majles. An unelected 12-member Guardian Council reviewed all legislation passed by the Majles for adherence to Islamic and constitutional principles and also screened presidential and Majles candidates for eligibility. In 2005 hardline conservative Mahmoud Ahmadi-Nejad won the presidency in an election widely viewed by the international community as neither free nor fair. Civilian authorities did not fully maintain effective control of security forces.

Leyla Zana is a person who has lived through all the difficulties of being a Kurd and a woman. She married very young, had children. Again when she was very young, her husband went to jail and she waited for years at the gates of prison houses. She entered active politics. She wanted to raise her people's voice. However, she went into prison as a result of the deadlock policies on the Kurdish problem. She was sentenced to 15 years. While in prison, she got ill. In spite of the existence of the forensic report that enabled her to be discharged, she did not want to in those cicumstances. She came out of prison, rejoined her children from whom she was separated for long years. At the same time, she started to share her ideas with the society. Again, adepts of violence could not support Leyla Zana's presence. Leyla was sentenced again to ten-year prison for her speeches. Her file is now at the Cassation Court. Let us not allow this time her imprisonment! As long as Leyla Zana and people like her who are not yielding to the system and who express their ideas remain in prison, we will not be free either. By signing this text, let us invite the Cassation Court to annul the sentence against Leyla Zana, and ask the members of Parliament to remove all sorts of legal obstacles in front of free expression of opinions.

The 5th International Annual conference has brought together contributors from all over the world including leading academics, writers, legal experts, human rights organizations and prominent Turkish and Kurdish intellectuals.

While the Conference welcomes the steps that have been taken in reforms since the conference last met, there is still a long way to go to get the process of accession moving again since it stalled in 2007. The title of this conference is 'Time for Change' but the initiative for change in Turkey must not come from within that country alone. The EU must take the lead in finding a peaceful resolution to this ongoing problem. It is essential that all of the groups involved make this a priority if the accession process is to move forward once more.

In addition to the above, The EUTCC Conference resolves to periodically make recommendations of measures for the Turkish accession process, the protection of human rights and the situation of the Kurds

"Asayish" released a war pilot who is guilty of genocide in Halabja

Karim Sabty is also known as Abu Yarub. He was a war pilot who participated in the chemical bombing of Halabja, March 16, 1988. He was released recently by the Asayish, possibly PUKs abetting.

During interrogation admitted Karim Sabty their involvement in the chemical bombing of Halabja.

Earlier criticized "Asayish" of human rights organizations because of the torture and the personal attacks against prisoners.

Another war pilot was Mohammad Tariq Ramadan who participated in the chemical bombing of Halabja. He was released by Asayish the end of 2008. Scandal revelation came from the Iraqi Supreme Court. According to the message of Ramadan had escaped from prison.

Kurdistan security forces "Asayish" controlled by the PUK and the PDKI. Some members take the law into their own hands and work for their own interests. Abuse of power and bribery is common.

These two pilots are guilty of genocide, and must be brought to justice. Asayish decision to release the prisoners is a major crime.

PDKI and PUK have to give up responsibility for Asayish to the KRG. Kurdistan Regional Government- KRG must take responsibility and control Asayish.

The guilty must be found immediately and put on trial.

Organization CHAK working against genocide, has started legal action against the guilty. Families who lost loved ones in Halabja showing their support for CHAK.

your inauguration speech, you stated that America will have a better approach with the
rest of the world in terms of cooperation, mutual understanding and respect. You also
appeared to promise that you would review and correct America’s unsuccessful policies
especially in regard to the Middle East.
A received wisdom of various US administrations is that Turkey plays a vital role in the
Middle Eastern stability and promoting America’s agenda in the region. Indeed Turkey
is poised to become a prominent nation not only for the region but also to play a larger
role in Asia and Europe. But this can only happen if Turkey bases its stability on the
premise of democracy and a guarantee of human rights for its citizens. It appears that this
can only happen if, with the encouragement of the US, the Turks amend their constitution
where every citizen of Turkey is guaranteed respect and equality before the law. Turkey
cannot remain prosperous and use slogans of democracy as a lapel pin rather than
adhering to democracy’s deepest principles -- principles that should be reflected in the
conduct of the Turkish state.

North Iraq (AINA) -- The Yezidi Movement for Reform and Progress, an independent entity in Iraq, won the one quota seat reserved in the Nineveh province for the Yezidi minority. The win has infuriated Kurdish leaders who were taken by surprise by the strong Yezidi opposition to Kurdish dominance.

Kurdish political groups have invested heavily over the past years in the Kurdification of the Yezidis (AINA 12-1-2008) by different methods as well as presenting them to the outside world as Kurds, amounting to an attempt to eradicate an ancient indigenous community with roots in ancient Mesopotamian civilization.

The surprising win of the independent Yezidi Movement for Reform and Progress in Nineveh province is seen as a rebuke of Kurdish aggression.

Commenting for AINA, Qanat Hammo, one of the founders of the Yezidi Movement for Reform and Progress, said "Despite all the oppression and coercion of the Kurds our people were able to fight back using the ballot box. We want them to leave us alone, we are not Kurds and they need to respect this fact." Yezidis are erroneously described as Kurds for political reasons, an identity to which they object. They make up the majority in the Sinjar area west of Mosul and in the Shekhan district in the Nineveh Plain.

Observers maintain the independent Yezidis won the seat because the Kurds were taken off guard.

"The Kurds thought they had the Yezidis in their pockets, so they put all their efforts on the Assyrians instead," said Qanat Hammo, "going to great length to make sure the Assyrian seat would be won by the Kurdish backed Ishtar slate, but they were really taken by surprise."

The Kurdish backed Ishtar slate won the Assyrian quota seat in the Nineveh province amidst many allegations of illegal campaign methods (AINA 2-12-2009, 2-10-2009).

Can you introduce yourself?
My name is Jan Beth-Şawoce. I was born in 1955 in Turabdin in northern Mesopotamia. I came to Sweden as a political refugee in 1975. Since I came to Sweden I have been active in various Mesopotamia compounds.

When was founded The Institute of Mesopotamia? What are the objectives?
The Institute of Mesopotamia was founded in 1998. Currently, the Institute has a collection of books in different languages for those interested on the different ethnic, religious and cultural communities in Mesopotamia. The collection is available at Södertörns University College (Södertörns Högskola) in Flemingsberg. Flemingsberg is in outside (south) of Stockholm.
Of course one of the objectives is to collect both new and old books on Mesopotamia. The Institute has published different books in Swedish, Neo-Syriac, English and Turkish about Mesopotamian modern history and languages.

Assyrian / Syriac language is one of the Middle East and even one of the old languages. What position has the language now? How can we preserve the language? Can you develop it?
In history we have had different classical and modern languages with the old spelling [characters]. Among the classical language which we have the Edessa [we call it for Urhoy].
The Edessaen´s language Syriac is well known among linguistics and scientists. Since the establishment of Christianity in the city of Edessa, which in located in northern Mesopotamia, at year 37 AD, Christianity came to different parts of the world. Edessean´s own language called for Syriac. Edessa had university and attracted many students from different parts of the world. The graduate students came to their home areas with knowledge of different subjects and among the Syriac language.

The Coalition for the International Criminal Court (CICC) is calling on Turkey to take the necessary steps to accede to the Rome Statute of the International Criminal Court (ICC). Increased ratifications of the Statute in the region will further strengthen the global voice at the Court and result in a more robust and meaningful participation in the global struggle to establish a truly fair, effective and independent ICC.

To date, Europe and the Central Asian Republics have 40 States Parties to the Rome Statute, 26 of which are European Union (EU) countries. The region also has 8 signatories to the Rome Statute (Armenia, the Czech Republic, Krygyzstan, the Kingdom of Monaco, the Republic of Moldova, the Russian Federation, Ukraine and Uzbekistan). Turkey has not signed the Rome Statute.

In the last three months, Amnesty International has received reports of waves of arbitrary arrests and harassment, directed particularly against members of Iran’s religious and ethnic minority communities, students, trade unionists and women’s rights activists. Amnesty International is aware of the apparent arbitrary arrest of, or other repressive measures taken against, over 220 individuals. Many, of those arrested, if not all, are at risk of torture or other ill treatment. Other individuals arrested before this period have been sentenced to death. In addition, several newspapers have been closed down, and access to internet sites has been restricted, including some relating to human rights or which are operated by international broadcasters. These measures may in part be intended to stifle debate and to silence critics of the authorities in advance of the forthcoming presidential election in June 2009. All individuals and groups should be allowed to peacefully exercise their rights to freedom of expression, association and assembly, including in ways which dissent from state policies and practices, in the run-up to the presidential election.

After the American occupation of Iraq, many murderers from the former regime were arrested; however some of them were later released by the American army and the Kurdish regional government.
Wafiq al Samurai is one of those murderers, he was the head of the former regime’s intelligence, but after the occupation and following the formation of the new government, Wafiq al Samurai became the adviser of the new Iraqi president Jalal Talabany.
Whilst in his intelligence post, Wafiq al Samurai led the genocide of the Kurdish people which is known as the Anfal operation. Anfal operation took place during 1987-1988, in result of the operation 182,000 Kurdish people were killed and then buried in mass graves, the victims were mostly women and children.
In august 2008, the Iraqi criminal court wanted Wafiq al Samurai for his crimes that he carried out against the Kurdish people but suddenly after few weeks he escaped Iraq to United Kingdom, now he lives in UK freely.
People of United Kingdom must be aware of how dangerous is Wafiq al Samurai and he must be arrested by the metropolitan police and be deported back to Iraq , in order pay the price of his genocide crimes.
I am from Halabja town; I was there when the town was gassed by the former regime in 1988. We left Halabja to Iran and we settled there for six months, then Saddam Hussein announced safety for those who left Halabja and promised them that if they come back to Iraq, they will be as safe as everybody else in Iraq.
My uncle Mikhail believed the announcement and he went back to Iraq with his wife and children in October 1988, his son was eight years old and his daughter was only six years old. However as he arrived in Iraq he was arrested by the Iraqi secret police, then he was taken to the deserts to be part of the Anfal operation, where he was shot and buried in mass graves with his family. This did not just happen to my uncle the same scenario was repeated to all those people who went back to Iraq.

Another genocide criminal is Tariq Mohammad Ramadan, a military pilot in the former Iraqi army. Ramadan participated in the chemical attack of Halabja town on March 16th 1988. He was a prisoner in the city of Sulemanyah in north of Iraq. The prison in Sulemanyah is controlled by the Kurdish security forces (Asaysh), but the media were told by Judge Mohammad al-uraibi in his public statement that Ramadan has escaped prison. However it is obvious that he was released by the Kurdish security forces as it was reported in (Awene) newspaper.

The Kurdish newspaper (Awene) reported: "Tariq Mohammad Ramadan’s family visited Jalal Talabany in city of Kerkuk, they asked him to release Ramadan and he ordered his release.” afterward the Kurdish security forces sent Ramadan to UK via the Sulemanyah airport. When he arrived in UK, he claimed asylum and after few weeks he received his indefinite remain in UK.
The Scotland Yard must arrest these murderers and they should be deported back to Iraq to face the law and be prosecuted for their inhuman crimes.

Last year’s EU Commission Turkey Progress Report, published in November 2007, was arguably its most critical to date; in many fields it suggested there had been little, if any, progress, and in very few did it claim that significant progress had been made. Despite the relationship between Turkey and the EU having weathered the storm created by the temporary suspension of accession negotiations on eight chapters from December 2006 to March 20071, by the time of the EUTCC’s 4th conference in December 2007, there seemed to exist a general feeling that progress towards the goal of Turkish EU membership was grinding to a halt. With several EU member state governments expressing strong reservations about the

possibility of Turkey ever joining the EU2 and support for joining the EU within Turkey down at 49%3 compared with 62% in 20044, the future of EU-Turkey relations did not seem bright.

Kurdish and Turkish people share hundreds of years of intertwined socio-cultural history. However, authoritarian and totalitarian approaches that emerged as the dominant ideological tools of the state rationality and, developing parallel to that, the state policies that deny and annihilate different identities, have been the main reasons for the Kurdish uprisings that have continued since the end of the 19th century to our day. The confrontational grounds that marked the last 30 years of Turkey have to be evaluated in the light of this historical reality. Evaluation of the issue as a concept of security and terror has gravely aggravated rather than contributing to the solution. It has become inevitable for the Turkish Republic to reject a pluralist and democratic method in the face of undeniable demands of the people. Consolidating this struggle for rights upon women’s struggle is indispensable for the understanding of justice and equality to fully settle into all levels of society. In this sense, it is clearly evident that the quasi-democratisation initiatives, which do not internalise the resolution of the women’s liberation as central to the issue, cannot maintain justice and equality.

Two days of Intense Lobbying for Iraqi and Turkish Minorities at UK parliament

This week, Assyrians,Armenians, Syriacs ,other Iraqi Christians, Mandaeans and Fylee Kurds took part in two days of intense lobbying of Members of the UK Parliament, coinciding with Hrant Dink Day in London.

On monday, Hrant Dink Day, a silent vigil was held by a crowd holding a banner "Turkey, respect your Minorities" in front of the Turkish Embassy. Later, in the evening, in the House of Commons, Deacon Yacoub Ghattas of the Syriac Church gave a presentation on the problems facing Mor Gabriel Monastery and the Syriac Community in Turkey. Contributions from Sabri Atman of Seyfo Centre and Abdulmesih BarAbrahem of the Assyrian Democratic Organisation were presented on the same theme. It is hoped that a motion in the UK parliament will result from this. The meeting was sponsored by Andrew Dismore MP
PROSPECTS FOR A DEMOCRATIC, PEACEFUL SOLUTION TO KURDISH QUESTION-EUTCC

We are now at a stage where the forces of democracy and international public opinion are pressing Turkey for a permanent solution to the Kurdish problem. As the facts are well known, for decades past, the Kurds and the Kurdish movement had been subjected to ever-intensifying practices of oppression, torture, military operations both inland and abroad, with use of tanks and heavy bombings. However, despite all of these assaults, the Kurdish movement could not be eliminated.

At this stage, a political change of direction has become inevitable for Turkey. Nevertheless, Turkey is still determined to continue with its liquidation policy. It is for this reason that instead of making constitutional reforms to acknowledge the Kurdish identity and rights, it is sufficing with some hollow, half hearted, fake steps in order to start a propaganda, claiming to have solved the Kurdish question.

A discussion took place at the Conference of Group Presidents of the European Parliament today, 29 January, following my intervention about the lawsuit against Ms Leyla Zana, winner of the Sakharov Prize.
The unanimous decision by the Conference of Presidents is as follows:

To invite Leyla Zana to a forthcoming meeting of the Conference of Presidents;
To send an official European Parliament delegation to the attend the lawsuit against Leyla Zana at the Court of Appeal, on 31 March next in Ankara;
To send a letter from the President of the European Parliament to the Commissioner in charge of membership negotiations with Turkey about this serious affair.

CHAK asks the Kurdish Regional Government uncover the fate of missing people captured during the Kurdish civil war


Dozens of relatives of victims of the Kurdish civil war and a few hundred of their supporters demonstrated and held a strike in front of the Kurdish Regional Parliament, demanding that the fate of 48 missing persons captured during the war between Patriotic Union of Kurdistan (PUK) and Kurdistan Democratic Party (KDP) in the mid 1990s be uncovered. They sent a request to the Kurdish parliament for the truth be revealed and for the families of the victims to be told what happened to these people.

Representatives of the Kurdish regional parliament told the demonstrators that they would have to talk to KDP and PUK, and that the parliament cannot do anything about this issue.

It is worth mentioning that hundreds of people were captured during the Kurdish civil war and disappeared forever. Hundreds of people were killed and many disappeared. Numerous people have been jailed due to the internal war, and some people are still sitting in prison even after the peace agreement between the two political parties in 1998.

FIFTH INTERNATIONAL CONFERENCE ON EU , TURKEY AND THE KURDS
Time for Change in Turkey !

To be held at the European Parliament, Brussels , 28-29 January 2009.

Since 2004 the EUTCC has held an annual conference in the European Parliament. One of its most important tasks is to monitor Turkish compliance with the EU accession criteria. EUTCC wishes to contribute to the progress of Turkish membership of the EU by spreading accurate, objective information both in Turkey and Europe about the progress made by Turkey , but also about any shortcomings which may still persist.

By these conferences the EUTCC also wishes to contribute to a democratic, peaceful and lasting solution of the Kurdish problem. It believes that this can only be achieved through a dialogue between the parties concerned, in which also the EU must play its part. This will require not only further changes in legislation, but a change in the ideology and mentality at all levels of Turkish society. From a state seeing the expression of Kurdish culture and language as a threat to its own existence, Turkey must become a state that recognizes differences and sees cultural diversity and freedom as positive and necessary elements of a true democracy.
In these five years there have been only minor reform changes in Turkey regarding the situation of the Kurds. This year’s conference brings together internationally recognized speakers from various disciplines and fields who together with the EUTCC patrons; Archbishop Emeritus Desmond Tutu, Dr. Shirin Ebadi, Bianca Jagger, Noam Chomsky, Yasar Kemal and Leyla Zana in different ways express their request for real changes in Turkey .
The 5th international conference is dedicated the late Nobel Laureate and Playwright Harold Pinter who has been patron of the previous conferences and a dear friend of the Kurds. The EUTCC honors Harold Pinter’s memory.

Further arrests of Kurdish activists in Syria
Two Kurdish activists were arrested on 26 October 2008. Mohammed Saed Hossein al-Omar and Sadoon Mahmoud Shekho are members of the leading committee of the Kurdish Azadi Party in Syria. They were arrested by the Syrian military security services in the towns of Romelan and Raas al-Ein.
Salah Saed Unis, a Kurdish activist was arrested on 31 October 2008 by military security services in Amuda town.
Mustafa Jum’a, aged 62, the deputy secretary of the Kurdish Azadi Party in Syria was arrested on Saturday 10 January 2009 by the Syrian military security services from the office of Farah Palestine in Damascus.
Nasser Daqori, born 1962 was arrested on 11 January 2009 by the political security services in Amuda town.
Darwish Qalib Darwish, born 1945 and one of the teachers developing the Kurdish language was arrested in Qamishli city on 13 January 2009 by the intelligence security services..
Kadar Mahmoud Saadoh was arrested on 16 January 2009, in Qamishli city by intelligence security services.

Editor's note: Facing massive criticism and intense scrutiny from European officials, the Turkish court in Mardin canceled the trial against the Saint Gabriel monastery scheduled for Christmas Eve and dismissed most charges that were to be adjudicated on that day, including the two main charges that the monastery was established illegally and its activities are violating Turkish law. The court scheduled trials for January 16, to address the issue of a wall the monastery built, and February 11, to determine if 270 hectares that were confiscated by the government belong to the monastery. The two people detained above are believed to have been detained since 2003, and were sentenced to death by stoning probably in 2005 or 2006. Their sentences are believed to have been confirmed by the Supreme Court sometime in 2008. The Head of the Judiciary declared a moratorium on executions by stoning in 2002, but at least five people are known to have been stoned to death since then, two of them on 26 December 2008.

Gilan Mohammadi and Gholamali Eskandari were sentenced to death by stoning for adultery. They are held in Esfahan Central Prison, in the centre of the country.

"Mosul has cut its connection with us. If we go there, the insurgents will kill us," said Eido Shingali, a resident of Sinjar, driving along the road to Dohuk. "This route takes longer but it is safe."

Giant truck bombs flattened two villages in Sinjar district in August 2007, killing more than 300 people in the bloodiest attack of its kind in Iraq since 2003.

The victims were mostly Yazidis. As Kurds who follow a pre-Islamic faith, they are doubly distinct from their Sunni Arab neighbours.

By sheer bulk, a Singapore-based company may have been the largest supplier of the chemicals used in the 1980's to make chemical weapons, including 3,300 tons of a chemical that can be used to make nerve gas and 950 tons of an separate chemical used to make mustard gas and sarin.

Under the 1991 cease-fire agreement, the Iraq government promised to provide lists of the suppliers of its programs to develop chemical, biological and nuclear weapons.
Weapons experts and veterans' groups have long advocated public disclosure of the lists, if only to make clear the need to tighten export laws.
''It is our policy not to reveal the names of suppliers,'' said Ewen Buchanan, a spokesman for Hans Blix, the United Nations' weapons inspector. ''There are many reasons why.''
Gary Milhollin, director of the Wisconsin Project, a Washington-based research group on weapons proliferation, said much of the chemical production equipment sold to Iraq in the 1980's may still be available.
If the United States carries out its threatened invasion of Iraq, he said, ''we're likely to send soldiers in to find and destroy this equipment if it's still there, early on.''
Mr. Milhollin said the foreign companies on the Iraqi list deserved to have their identities known. ''If you look at the scale and frequency of the exports of some of these companies, it's clear that they were deeply involved in Iraq's chemical weapons program,'' he said. ''They must have known what was going on.''

The camp was one of Iraq's grimmest prisons. During his month-long internment there, the 12-year-old Kurdish boy watched guards beating male prisoners senseless with lengths of coaxial cable. He had seen four children weaken and then die of starvation. He stood helplessly as a guard stripped his father to his undershorts and led him off to his death. So Taymour was not sorry to see the last of Topzawa. He did not know that the paper in the guard's hand was an execution list.

Inheritance from a Turkish father was shown to be taken from an Assyrian who was killed during the genocide in 1915. Berzan Boti is now apologizing for what his forefathers did and is returning the house and other properties to its rightful owners.

At the end of 2008 a ninety year old taboo about the genocide was broken. Approximately 200 intellectual Turks started an appeal, apologizing to the Armenians for what happened in 1915 (AINA 12-12-2008). The genocide (called Seyfo in Assyrian) was called "the huge disaster" in the appeal.

Berzan Boti has bequeathed all properties to the Seyfo Center, a genocide studies institute based in Sweden. The properties were owned by Assyrians before the Seyfo genocide in 1915.

A year ago, Berzan Boti contacted the Seyfo Center. In the letter he apologized for what had happened in 1915 and expressed his willingness to return the properties:


"When I found out that the properties that I and my brothers inherited from our father wasn't our own, but properties taken from the murdered Assyrians in 1915 I felt an indescribable feeling of guilt and shame. I've been thinking long and hard before I have come to this decision. I tried to put myself in their position. I have personally apologized to every Assyrian and Armenian I've meet. But this does not get rid of the crime our ancestors committed. Even if I am personally not responsible for what happened in 1915, I felt as I had to do more than just to apologize. Finally, I came to the decision to give back all properties that I inherited from my forefathers to Seyfo Center, who struggles for a confession of the Seyfo genocide in 1915".

Berzan Boti has now signed a document saying that Sabri Atman, founder of Seyfo Center, is responsible for the properties. Atman received the letter and says that Boti's action is honorable.

"This is the beginning; I hope that other people that got properties during the Seyfo genocide caused will take their responsibility as Berzan Boti did," says Sabri Atman.

The transfer of property to Seyfo Center will take place during a press conference in Sweden in the spring.

Farzad Kamangar, 33 years old Kurdish, is a member of the human rights
activists, a teacher, and a journalist in Iran. He was in charge of public
relations of the Kurdish branch of the teachers union before the union was
outlawed. In July of 2006, upon my arrival in Tehran to follow up with his
brother's medical treatments Farzad was arrested. His prison conditions,
torture, and 7month of solitary confinement has been noted in the human
rights organizations, including Amenity International's documentations. On
February 25th 2008, Farzad sentence to death for "risking national security".
The following is Farzad's latest letter to Mohseni Ejeie, the mister of
Iranian intelligence.
